1. About these terms
These Terms of Service ("Terms") are an agreement between you and INDOSABEST LTD ("we", "us", "our"), a company registered in Nigeria with its office at 46 Wambai Salihu Street, Azare, Bauchi State. They apply to your use of INGARMA, our platform for sharing and discovering photographs and films from Africa (the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy policy. If you do not agree, please do not use INGARMA.
2. Who can use INGARMA
You must be at least 18 years old, or have reached the age of majority where you live, to create an account. If you use INGARMA on behalf of a studio, company or organisation, you confirm that you have authority to accept these Terms for it.
You may browse public content without an account. You need an account to upload, comment, follow, save to collections or manage a plan.
3. Your account
- Give accurate information when you register, and keep it up to date.
- Keep your password private. You are responsible for activity on your account.
- Tell us promptly at [email protected] if you believe your account has been used without your permission.
- One person should hold one account. Do not impersonate another person or creator.
4. Your content and your rights
"Your content" means the photographs, films, captions, titles, descriptions, tags, comments, collections and profile material that you post on INGARMA.
You keep ownership of your content. We do not claim ownership of your photographs or films.
To run the Service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, convert, display and distribute your content on and through INGARMA, and to show previews of it (for example thumbnails, search results and links shared by you or others) so that people can discover your work. We may also feature your content within INGARMA, always with your name as creator.
This licence ends when you delete your content or your account, except for copies that are shared by others as permitted by the Service, and backup copies that are kept for a limited time before being deleted in the ordinary course.
You are responsible for your content. You promise that you own it or have all the permissions needed to post it, and that posting it does not break the law or anyone else's rights.
5. Credit and attribution
Every photograph and film on INGARMA is shown with its creator's name and a link to the creator's profile. Do not remove or hide credit, and do not claim someone else's work as your own.
6. What you may post
You may post only work that follows these rules. You must not post content that:
- infringes copyright, trademark or other rights, including work taken from other creators or from the internet without permission;
- is sexually explicit, or sexualises children in any way. We report child sexual abuse material to the authorities;
- shows graphic violence or cruelty for shock value, or encourages violence, self-harm or hatred against people because of who they are;
- harasses, threatens, defames or exposes private information about others;
- is misleading in a way that could cause harm, such as a photograph presented as documentary evidence that has been staged or fabricated;
- contains malware, or is spam, advertising unrelated to your work, or repeated duplicate posts;
- is illegal in Nigeria or in the place where you post it.
If an image or film has been created or substantially altered using artificial intelligence or other synthetic tools, say so in its description. Do not present it as an unedited photograph.
Choose the right category, culture and place for each post. Use tags honestly, and do not mislead viewers about where or when something was made.
7. People in your photographs and films
- Respect the people you photograph. Where the law or good practice requires consent, get it before you post.
- Take particular care with children, people in distress, and people photographed in private settings. Do not post images that could put someone at risk.
- If someone asks you to remove an image of them that you posted without their permission, please do so promptly, and we may remove it if you do not.
8. Using other people's work
Work on INGARMA belongs to its creators. Unless a creator has given you permission in writing, you must not copy, download, repost, sell, print or use their photographs or films for any purpose outside INGARMA.
You must not use automated tools to scrape or collect content or profile information, and you must not use anyone's content to train machine learning or artificial intelligence systems without that creator's permission.
If you want to license or use a creator's work, contact the creator through their profile.
9. Plans, uploads and payments
INGARMA offers free and paid plans. What each plan includes, such as the number of uploads or the amount of storage, is described on the pricing page and in your dashboard usage meters.
- Prices are shown in Nigerian naira (₦) unless stated otherwise, and include any taxes we are required to charge unless stated otherwise.
- Paid plans are paid in advance for the period you choose. Payments are processed by our payment partners. We do not store your full card details.
- If you reach a plan limit, you may need to upgrade or remove content before you can upload more.
- We may change plan features and prices. We will tell you in advance of any change that affects a plan you have already paid for, and changes will apply from your next billing period.
- Unless required by law or stated when you buy, payments for a period that has started are not refundable. If you believe you were charged in error, contact us within 14 days.
10. Comments, collections and conduct
Be respectful when you comment on other people's work or follow other creators. Do not post abusive, discriminatory or off-topic comments, and do not use the Service to pressure or deceive others.
Collections you create may be seen by other people according to the settings you choose. Do not use collections to republish other creators' work in a way that misleads viewers about who made it.
11. Reporting and moderation
You can report content or comments that break these Terms using the report option. We review reports and may remove content, restrict an account or take other action. We may also act on content we find ourselves.
When we remove content or restrict an account for breaking these Terms, we will tell you why where we reasonably can, and you may reply to us at [email protected] to ask us to review the decision.
12. Copyright complaints
If you believe content on INGARMA infringes your copyright, email [email protected] with:
- your name and contact details;
- a description of your original work and, where possible, a link to it;
- the link to the content on INGARMA that you say infringes it;
- a statement that you are the owner or are authorised to act for the owner; and
- a statement that the information in your notice is accurate.
We may remove or disable access to the content while we look into the complaint, and we will tell the person who posted it. They may respond if they believe the removal was a mistake. We may close the accounts of people who repeatedly infringe the rights of others.
13. Our property
The INGARMA name, logo, design, software and the way the Service is put together belong to INDOSABEST LTD or its licensors. These Terms do not give you any right to use them, except to use the Service as these Terms allow. Your content remains yours.
14. Third-party services and links
INGARMA may contain links to other websites or use services from other companies, such as payment processors. We do not control those services and are not responsible for them. Their own terms and privacy policies apply when you use them.
15. Suspension and ending your account
You can stop using INGARMA and ask us to delete your account at any time. Closing your account does not by itself cancel a paid period that has already started.
We may suspend or close your account, or remove content, if you seriously or repeatedly break these Terms, if we are required to by law, or if your use puts the Service or other people at risk. Where reasonable, we will give you notice and a chance to respond first.
16. The Service as provided
We work to keep INGARMA available and secure, but we provide it "as is" and "as available". We do not promise that it will be uninterrupted or error-free, or that content will never be lost. Keep your own copies of your original photographs and films. We do not endorse, and are not responsible for, content posted by users.
17. Limit of our liability
To the fullest extent permitted by Nigerian law, INDOSABEST LTD is not liable for indirect or consequential loss, loss of profits, loss of data, or loss of opportunity arising from your use of INGARMA. Our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose, or ₦00,000.00 if you have not paid anything.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence, or any rights you have as a consumer.
18. Your responsibility to us
You agree to compensate us for loss, claims and reasonable costs that we suffer because of your content or because you broke these Terms or someone else's rights.
19. Changes to these Terms
We may update these Terms from time to time. We publish each version on this page with its version number and effective date, and earlier versions stay available. For significant changes we will notify you, for example by email or a notice in the Service, before the new version takes effect. If you keep using INGARMA after the effective date, you accept the updated Terms. If you do not accept them, you can close your account.
20. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. If you have a problem, please contact us first so we can try to resolve it in good faith. If we cannot, the courts of Nigeria have jurisdiction, subject to any rights you have as a consumer under the law of the place where you live.
